                  Hon’ble  Ravindra   Maithani,  J. (Oral)                          
                            Applicant is in judicial custody in FIR No.191          
                  of 2022, under  Sections 8/18/29  of the Narcotic Drugs           
                  and  Psychotropic Substances   Act, 1985, Police Station          
                  Transit  Camp,  District Udham   Singh  Nagar.  He  has           
                  sought his release on bail.                                       
                  2.        Heard   learned counsel  for the  parties and           
                  perused  the record.                                              
                  3.        According  to the FIR, on 29.11.2022, two  co-          
                  accused  were  apprehended  and  from  their possession,          
                  opium  was recovered. They  told the police that they were        
                  to give the opium to the applicant.                               
                  4.        Learned   counsel  for  the  applicant  would           
                  submit  that there is no evidence against the applicant.          
                  Co-accused  from whom   opium was recovered had  already          
                  been  granted bail. There is no other evidence against the

                  applicant  except  the  statement   of the  co-accused.           
                  Applicant is not a previous convict.                              
                  5.        Learned  State Counsel  does  not dispute the           
                  factual narration as made by the learned counsel for the          
                  applicant.                                                        
                  6.        Having  considered, this Court  is of the view          
                  that the applicant deserves to be enlarged on bail.               
                  7.        The bail application is allowed.                        
                  8.        Let the applicant be  released on bail, on his          
                  executing  a personal bond  and  furnishing two  reliable         
                  sureties, each of the like amount, to the satisfaction of the     
                  court concerned.
