                                    3.   Learned counsel for the petitioner submits
                                    that the issue as raised in the present petition is
                                    squarely covered by  the  judgment  dated     
                                    04.04.2024 rendered by the Division Bench of  
                                    this Court in bunch of Special Appeals, the   
                                    leading one is Special Appeal No. 245 of 2022,
                                    Managing  Director, Uttarakhand Transport     
                                    Corporation and  others vs. Ashok Kumar       
                                    Saxena.                                       
                                    4.   Mr. N.S. Pundir, learned counsel, who    
                                    appears  for  the  Uttarakhand  Transport     
                                    Corporation, have not disputed this fact and also
                                    submits that the issue as raised in this petition is
                                    squarely covered by the said judgment.        
                                    5.   In view of the statement as given, the   
                                    present writ petition is disposed of in terms of
                                    judgment passed by the Division Bench of this 
                                    Court dated 04.04.2024 in bunch of Special    
                                    Appeal No. 245 of 2022, Managing Director,    
                                    Uttarakhand Transport Corporation and others  
                                    vs. Ashok Kumar Saxena.
