The applicant is in judicial custody in FIR
No.280 of 2018, dated 26.07.2018, under Sections 3(1) of
the Uttar Pradesh Gangsters and Anti-Social Activities
(Prevention) Act, 1986 (“the Gangsters Act”), Police
Station Bazpur, District Udham Singh Nagar. He has
sought his release on bail.
2. Heard learned counsel for the parties and
perused the record.
3. The applicant was facing trial in a case based
on FIR No.280 of 2018, under Section 3(1) of the
Gangsters Act. It appears that the applicant did not
appear during trial and Non Bailable Warrants were
issued against him. He is in custody since 02.09.2024.

4. Learned counsel for the applicant would
submit that the bail of the applicant has never been
cancelled; the applicant is a labourer, who has gone for
his livelihood; he could not attend the court.
5. Having considered, this Court is of the view
that it is a case fit for bail and the applicant deserves to
be enlarged on bail.
6. The bail application is allowed.
7. Let the applicant be released on bail, on his
executing a personal bond and furnishing two reliable
sureties, each of the like amount, to the satisfaction of the
court concerned.
