                       Learned counsel Mr. S. Lodh along with Mr. K. Roy, Learned   
                  counsel and Mr. S. Majumder, Learned counsel is present for the   
                  appellant-petitioner and Mr. Raju Datta, Learned P.P and Mr. S.   
                  Ghosh, Learned Addl. P.P. is present for the State.               
                       This bail application is filed under Section 483(1)(a) of BNSS
                  for release of accused on bail who is in custody in connection with
                  NCC   PS   FIR  No.071   dated   21.08.2024   under   Section     
                  61(2),249,111,143 of BNS, 2023.                                   
                       Heard both the sides at length.                              
                       Learned counsel for the appellant has drawn the attention of 
                  the court that  the accused  is in custody  with effect from      
                  22.08.2024 and the statutory period is likely to expire soon. So he
                  urged for releasing the accused on bail on any condition.         
                       Learned P.P. and  Learned Addl. P.P. on the  other hand      
                  opposed the bail application and submitted that in absence of     
                  Case Diary there is no scope to release the accused on bail at this
                  stage.

                       Considering the facts and circumstances of the case at this  
                  stage this court is not inclined to consider the bail application of
                  the accused person.                                               
                       Hence, the application is accordingly stands dismissed.      
                       However, considering the period of detention of the accused  
                  in custody the accused shall be at liberty to approach to the     
                  concerned court for bail and the concerned court shall deal the   
                  matter in accordance with law.                                    
                       With this observation this case is disposed of.              
                       A copy of this order be supplied to the Learned counsel Mr.  
                  S. Lodh appearing for the appellant.
