Order
08/10/2024
This is an application filed under Section 482 of the BNSS, 2023 for
granting pre-arrest bail to the accused-applicant in connection with
Dharmanagar Women PS case No.25 of 2024 registered under Sections 69
and 115(2) of the BNS Act, 2023.
Heard Mr. Koomar Chakraborty, learned counsel appearing for the
accused-applicant. Also heard Raju Datta, learned PP appearing for the
State-respondent.
In pursuance of the order dated 07.10.2024, today, both the accused-
applicant, namely Sri Partha Das and the complainant have appeared before
this Court. Sri Partha Das, the accused-applicant has expressed his
willingness to marry the complainant. However, the complainant is not
ready to marry him. The complainant has stated that she willingly
accompanied the applicant to Dharmanagar and stayed there. However, the

complainant has further stated that the accused-applicant had slapped her. In
view of this, the matter does not come within the purview of Section 69 of
the BNS, 2023.
In this circumstance, I am inclined to grant anticipatory bail in favour
of the accused-applicant.
Accordingly, it is ordered that in the event of arrest, the accused-
applicant, namely Sri Partha Das shall be released on bail on furnishing a
bond of Rs.25,000/- (Rupees twenty five thousand) with one surety of like
amount to the satisfaction of the arresting authority.
However, it is directed that the accused-applicant, namely, Sri Partha
Das shall appear before the Investigating Officer once in a fortnight and he
will cooperate with the process of investigation.
In terms of the above direction, the instant anticipatory bail
application stands allowed and disposed.
