                    When the matter is taken up Mr. S. Das, learned counsel appearing for
               the appellant has submitted that he wants to withdraw the instant appeal with
               a liberty to file afresh.                                            
                    Considered.                                                     
                    Accordingly, the instant appeal is allowed to be withdrawn and thus,
               disposed of as withdrawn. However, liberty is reserved with the appellant to
               file a fresh.
