Heard learned counsel for the respective parties.
Mr. Kohinoor N. Bhattacharya, learned G.A. along with Mr. D.
Sarma, learned Addl. G.A. appears on behalf of the State submits that the case
of the petitioner is pending before the respondents and notice has been issued

for personal appearance of the petitioner on 5 of February, 2024 and final

order would be passed by respondent authority by 20 February, 2024.
In view of the said submission made at the Bar on behalf of the
State respondents, petitioner seeks to withdraw the same to challenge the
proceeding if any, filing afresh.
Accordingly, this writ petition is dismissed as withdrawn.
It is further observed that petitioner is at liberty to submit any
written objection(s) along with documentary evidences, if advised, on the date

of enquiry i.e. 5 of February, 2024. However, it is made clear that petitioner
