Heard Mrs. S. Deb (Gupta), learned counsel appearing for the
petitioners also heard Mr. S. S. Dey, learned Advocate General assisted by Ms. A.
Chakrbaorty, learned counsel and Mr. B. Debbarma, learned counsel appearing for
the respondents.
Ms. Deb Gupta, learned counsel appearing for the petitioners has
submitted that the petitioner No.1 has not applied to seat in the examination. As such,
insofar as the petitioner No.1 is concerned she is not pressing the case of the
petitioner No.1 hence, the writ petition is dismissed insofar as the petitioner No.1.
Mr. S. S. Dey, learned Advocate General assisted by Ms. A.
Chakraborty, learned counsel appearing for the respondent has submitted that the
respondent TTAADC is an independent entity/autonomous body and there is no
documents under which they have adopted the Government notification and
challenging the said notification in this writ petition when there is no specific
impugned proceeding denying the application of the petitioners in absence of any
cause of action, the present petition is premature and needs to be dismissed.
In view of above, this Court is of the opinion that since there is no
cause of action and the respondent TTAADC has accepted the application now, it is
their discretion to decide the matter as per procedure. Accordingly, the present writ
petition is dismissed as infructuous.
