Heard Mrs. S. Deb(Gupta), learned counsel appearing for the
petitioner. Also heard Mr. M. Debbarma, learned Addl. GA appearing for
the State-respondents.
Mrs. Deb(Gupta), leaned counsel for the petitioner has submitted that
a disciplinary proceeding was initiated against the petitioner. On completion
of the proceeding, disciplinary authority found him guilty of committing
misconduct. According to the said authority, the charge framed by them has

been proved. Against the impugned order of penalty, the petitioner had
preferred statutory appeal before the appellate authority on 19.07.2024. The
appeal was supposed to be disposed of within a period of one month as per
relevant provisions of CCS (CCS) Rules, 1965, but till today it has not been
disposed of. The petitioner by filing the instant writ petition has sought for a
direction upon the appellate authority to dispose of the appeal expeditiously.
Mr. Debbarma, learned Addl. GA for the State-respondents has fairly
submitted that the appeal will be disposed of within a period of 3(three)
weeks since statutory period for disposing the appeal has been expired.
Accordingly, the respondents-Appellate Authority is directed to
dispose of the appeal within a period of 3(three) weeks from the date of
receipt of a copy of this order either by the petitioner or by the learned Addl.
GA.
With the aforesaid direction, the instant writ petition stands allowed
and thus disposed of.
