1. The present writ petition filed by the petitioner against
the respondents seeks the quashing of the impugned Order
dated 16.03.2024 passed by the District Magistrate,
Gangtok directing the petitioner to vacate the house within
two months, apparently under the Maintenance and Welfare
of Parents and Senior Citizens Act, 2007.
2. Mr. Shakil Raj Karki, learned Government Advocate
representing the District Collector-respondent no.4 submits
that the respondent no 4 vide Memo No.413/DC/GTK/2024
dated 25.07.2024 signed by him on 19.07.2024 has
withdrawn the impugned Order dated 16.03.2024. Without
examining the merits of the reasons given in the Memo No.
413/DC/Gtk/2024 dated 25.07.2024 it is taken on record
and marked X . A copy of the same has also been handed

over to the learned counsel for the petitioner.

3. In view of the withdrawal of the impugned Order dated
16.03.2024 nothing further remains to be agitated in the
present writ petition.
