1. These bail applications have been filed under Section 483 of
the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of
accused-petitioners. The petitioners have been arrested in
connection with FIR No.EPF/BAR(192)/2024-25/29 registered at
Excise Police Station Shahbad, District Baran for offence under
Section 19/54 of the Rajasthan Excise Act, 1950.
2. Learned counsel for the petitioners submits that the offence
as alleged against the petitioners is triable by the Court of
Magistrate. They also submits that co-accused has already been
released on bail and the cases of the present petitioners are not
distinguishable in any manner that from the case of co-accused-
Praveen @ Bunti Saxena, therefore, the petitioners may be
released on bail.
3. Learned Public Prosecutor vehemently opposed the bail
applications.
4. Considering the submissions made by learned counsel for the
petitioners and perused the material available on record.
5. Taking into consideration the fact that the offence as alleged
against the petitioners is triable by the Court of Magistrate and the
co-accused has already been released on bail, this Court without

expressing any opinion on the merits/demerits of the case, deems
just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, these bail applications under Section 483
B.N.S.S. are allowed and it is ordered that the accused-petitioners
named above in connection with FIR No.EPF/BAR(192)/2024-
25/29 registered at Excise Police Station Shahbad, District Baran
shall be enlarged on bail provided each of them furnishes a
personal bond in the sum of Rs.1,00,000/- with two sureties of
Rs.50,000/- each to the satisfaction of the learned trial Judge for
their appearance before the Court concerned on all the dates of
hearing and as and when called upon to do so.
