01. 1. Heard learned counsel for the Petitioner and learned
counsel for the State.
2. Being aggrieved by the order dated 22.06.2023 in G.R.
Case No.12 of 2019 by the learned Special Judge (POCSO),
Berhampur, Ganjam, issuing order of N.B.W(A), the Petitioner has
approached this Court.
3. It is submitted by the learned counsel that non-appearance
of the Petitioner on the date fixed was not out of volition but
because of compelling circumstances.
4. Taking into account the same, the order directing issuance
of N.B.W(A) is set aside and it is directed that in the event the
Petitioner surrenders before the learned Court in seisin on
24.06.2024 in connection with the aforesaid case, he shall be
released on bail on earlier terms.
5. It is made clear that in the event the Petitioner does not
surrender on 24.06.2024 as undertaken, it shall be open for the
learned Court in seisin to take necessary consequential action in
accordance with law for securing attendance of the Petitioner.
6. The CRLMC is accordingly disposed of.
7. Urgent certified copy of this order be granted as per rule.
