01. 1. The matter is taken up through hybrid mode.
2. Heard Mr. M.K. Mohanty, learned counsel for the Petitioners and
Mr. U.K. Sahoo, learned ASC.
3. The Petitioners are the cultivators of village Belmunda under
Samsingha GP in the district of Jharsuguda. Their grievance is that
earlier they were permitted to irrigate their farm lands from the local
water reservoir namely Samasingha Badakata (Belmunda Kata). But after
the reservoir was given in auction for Pisciculture, they are not permitted
to take water from the same. It is also submitted that they have made
representations to different authorities including the Block Development
Officer, Kolabira, but no one has heeded to their grievances.
4. Considering such grievance of the Petitioners, the writ petition is
disposed of with a direction to the Block Development Officer, Kolabira
(O.P. No.3) to consider and dispose of the representation of the Petitioner

under Annexure-4 dated 26 February 2024, in accordance with law, as
expeditiously as possible, within a period of one month from the date of
receipt of certified copy of this order. The BDO is further directed to
consider immediate release of water (within one week) from the reservoir
to the farm lands of present Petitioners keeping in view the ensuing
Summer.
5. An urgent certified copy of this order shall be issued on proper
application.
