           01.     1.     This matter is taken up through hybrid mode.            
                                     th                                           
                   2.     Order dated 24 August, 2023 passed by learned Civil Judge,
                   Rairakhol in Title Suit No.96 of 2001 is under challenge in this CMP,
                   whereby the suit was dismissed for default.                    
                   3.     Since the Petitioner has a remedy before learned trial Court to
                   seek for restoration of the suit, I am not inclined to entertain the CMP.
                   4.     Accordingly, the CMP is disposed of.
