THE HON’BLE MR. JUSTICE CHITTARANJAN DASH
                                    ORDER
  Order No.
                                 31.07.2024
      02. This matter is taken up through Hybrid arrangement
               (video conferencing/physical mode).
Heard Mr. S.R. Jena, learned counsel for the
petitioner and Mr. Arupananda Das, learned counsel
               appearing for the opposite party.
Mr. Jena, learned counsel for the petitioner
submitted that earlier the petitioner approached this Court
in W.P.(C) No.3096 of 2024 which was disposed of on
13.02.2024. The order indicates that during course of
hearing, learned counsel for the petitioner withdrew the
writ petition seeking liberty to file an application before
the Bank-opposite party for consideration of O.T.S. of the
outstanding dues towards the loan availed by the
petitioner and in that event, the opposite party was
directed to consider the same on its own merit and
                                                                     Page 1 of 2

dispose of the same in accordance with law at an early
               date.
In the present writ petition, prayer has been made
for a direction to the opposite party to stop the bidding
process, which was going to be held on 25.03.2024. The
writ petition was filed on 22.03.2024.
When a query is made by this Court to the learned
counsel for the petitioner as to what happened on
25.03.2024 and thereafter, he submitted that he has
obtained instruction that there is no further progress in
               the matter.
However, Mr. Dash, learned counsel appearing for
the opposite party has produced the letter dated
13.03.2024 issued by the Manager, Canara Bank,
Satyabadi Branch, which indicates that the offer of the
petitioner was not accepted in view of the bank guidelines
for O.T.S. The letter so produced is taken on record.
At this stage, learned counsel for the petitioner
seeks permission of this Court to withdraw the writ
petition to approach the appropriate forum.
Accordingly, the writ petition is disposed of as
withdrawn with the liberty as prayed for.
