01. 1. Heard.
2. The Petitioners are facing prosecution in S.T. Case
No.409 of 2003 arising out of Badachana P.S. Case
No.108 of 2000 pending in the Court of learned
Assistant Sessions Judge, Chandikhole.
3. The Petitioners were earlier on bail, however, they
did not appear before the Court below on 05.08.2021
leading to the issuance of NBW against them.
4. Learned counsel for the Petitioners on instruction
from his client undertakes that his client would be
appearing before the Court below on or before 30th

May, 2024 and seek appropriate remedy available to
him under law.
5. Taking into consideration the above facts and
submission at the Bar, the order dated 05.08.2021
passed by the learned Assistant Sessions Judge,
Chandikhole in S.T. Case No.409 of 2003 arising out of
Badachana P.S. Case No.108 of 2000 is set aside,
subject to the Petitioners paying cost of Rs.500/- each
to be deposited in the Orissa High Court Advocates’
Welfare Fund.
6. The CRLMC is disposed of.
