             1.   Heard Mr. S.A.Sheikh, learned counsel for the applicant.        
             2.   Issue notice.                                                   
             3.   Mr. N.D.Chullai, learned AAG assisted by Mr. E.R.Chyne, learned GA
             is present and accepts notice on behalf of all the respondents, so no further
             notice is required.                                                  
             4.   This application seeks condonation of 94 days in preferring the instant
             writ appeal.                                                         
             5.   Mr. S.A.Sheikh, learned counsel submits that the delay in filing the
             appeal was due to the ill health of his mother, with which he was preoccupied.
             He prays that the delay be condoned and the appeal be admitted for   
             consideration.                                                       
             6.   Mr. N.D.Chullai, learned AAG though voicing his objections with 
             regard to the sketchy details contained in the application for condonation,
             however, submits that as the delay is not substantial, he has no objection.
             7.   Accordingly, in the interest of justice, delay is condoned and the appeal
             shall come up for admission hearing after winter vacations.          
             8.   Misc. case accordingly stands disposed of.
