[1] Heard Mr. N. Bipin, learned counsel for the
applicant/petitioner and Mr. S. Niranjan, learned G.A. on behalf of the State
respondent.
[2] The petitioner who is a constable in Manipur Police
approached this Court by way of writ petition No. 269 of 2024 challenging
the memorandum of charge initiating the departmental proceeding against
him. Vide order dated 17.04.2024, this Court issued notice and observed
that disciplinary authority shall not finalize the departmental enquiry without
the leave of this Court.
[3] By the present application being MC(WP(C) No. 577 of 2024,
the petitioner prayed for passing an appropriate order as passed in the
similar matter i.e. vide order dated 29.11.2023 in a batch of writ petitions
being WP(C) No. 93 of 2024, etc. whereby the State respondent was
permitted to pass any order with regard to revocation of the suspension of
the petitioners therein during the pendency of the writ petition.
[4] Mr. N. Bipin, learned counsel for the applicant/petitioner,
submits that the applicant is also similarly situated with the petitioners in
other pending writ petitions and similar relief may be granted to the
petitioner also.
[5] Mr. S. Niranjan, learned G.A. for the State respondent,
submits that this Court may appropriate pass order as in the connected
matters.
[6] Recording the submissions made at the bar, it is clarified that
pendency of the present writ petition shall not bar on the State respondent
in passing any appropriate order with respect to revocation of the
suspension order of the applicant/petitioner.
[7] With this observation, the application being MC(WP(C) No.
577 of 2024 is allowed and disposed of.
[8] List the remaining matters on 18.11.2024.
[9] Interim order, if any, is extended till the next date.
[10] WP(C) No. 1087 of 2022: Present Ms. Rinika, learned
counsel for the petitioner and Mr. Shyam Sharma, learned G.A. for the
State respondent.
[11] List this case on 24.10.2024 along with WP(C) No. 575 of
2018.
[12] Earlier interim order is extended till the next date.
