Mr. Kh. Thoungamba, learned counsel, appears on behalf of the
petitioners.
The present transfer petition has been instituted on behalf of the
petitioners/accused in Sessions Trial No. 1 of 2023, originally pending before the
Court of learned Sessions Judge, Thoubal.
A perusal of the record reflects that this Court, on the request of
the District & Sessions Judge, Thoubal, transferred the subject Sessions Trial to
the Court of Sessions Judge, Imphal East, as evidenced by the communication
dated 20.12.2022 addressed by the Registrar (Judicial), High Court of Manipur,
to the District & Sessions Judge, Thoubal.
Notice.
Mr. RK Umakanta, learned PP, accepts notice on behalf of the State
of Manipur.
A perusal of the transfer petition reflects that the alleged offences
for which the petitioners/accused have been charge-sheeted, admittedly
occurred at Kakching, within the territorial jurisdiction of the Court of learned
Sessions Judge, Thoubal.

In addition, it is observed that the petitioners/accused are mainly
from Kakching and some of them are stated to be senior citizens.
In view of the foregoing legal position qua territorial jurisdiction as
well as in order to obviate the inconvenience caused to some of the accused,
who are senior citizens, there is no impediment in transferring the Sessions Trial
No. 1 of 2023 to the Court of learned Sessions Judge, Thoubal, for further
proceeding in accordance with law.
Directed accordingly.
No further directions are prayed for.
Tr. P. (Crl.) No. 1 of 2024 is disposed of accordingly.
Registry is directed to send copy of this order to both the concerned
Session Judges.
