applicant; Mr. K. Modhusudon, learned counsel appearing for the

learned counsel appearing for the respondents No. 2 and 3, Mr. S.
Vijayanad Sharma, learned counsel appearing for the respondent No. 4,
Ms. Bidyarani, learned counsel appearing for the respondent No. 5,
Mr. L. Sanjoy, learned counsel appearing for the respondent Nos. 6 and 7
and Mr. S. Biswajit, learned senior counsel appearing for the respondent

The present application has been filed with a prayer for allowing
impleadment of the present applicant, viz., Shri Sharatkumar Maimom, as
respondent No. 10 in the connected WP(C) No. 826 of 2023 on the ground
that the applicant is a necessary party in the said writ petition.
The counsel appearing for the respondents fairly submitted that
they have no objection in allowing the present application.
In view of the submission made by the counsel appearing for the
parties and on perusal of the record, this court find sufficient ground for
allowing the present application. Accordingly, the present application is
allowed.
Registry is directed to implead the present applicant as
respondent No. 10 in the connected WP(C) No. 826 of 2023.
With the aforesaid direction, the present application is
disposed of.

Heard Mr. K. Modhusudon, learned counsel appearing for the
writ petitioner and Mr. S. Vijayanand Sharma, learned counsel appearing
for the petitioner in CRP(CRP Art. 227) No. 55 of 2023. Heard also,
Mr. L. Sanjoy, learned counsel appearing for the respondents No. 5 and 6,
Mr. S. Biswajit, learned senior counsel assisted by Mr. Sanatomba, learned
counsel appearing for the respondent No. 8, Mr. Devdata, learned counsel
assisting Mr. A. Jagjit, learned counsel appearing for the Election
Commission of India and the Chief Electoral Officer, Ms. Bidyarani, learned
counsel appearing for the Assistant Returning Officer and Mr. S.
Vijayanand Sharma, learned counsel appearing for the State Returning
Officer in the connected two writ petitions.
At the outset, Mr. K. Modhusudon, learned counsel and
Mr. S. Vijayanand Sharma, learned counsel submitted that the present
two writ petitions as well as the connected Civil Revision Petition can be
disposed of by issuing a simple direction to elect a full-fledged President of
the Manipur People s Party by holding an election strictly in terms of the
’
provisions under the Constitution of the Manipur People s Party and the
’
Elect Party, 1992 and amendments

All the counsel appearing for the respondents also fairly
submitted that by issuing such a direction as submitted by the counsel

appearing for the petitioners, both the two writ petitions as well as the
connected Civil Revision Petition can be disposed of.
In view of the above submission and as agreed to by all the
counsel appearing for the parties, the present two writ petitions and as well
as the connected Civil Revision Petition are hereby disposed of with the
following directions:-
(a) The Chief Electoral Officer, Manipur (respondent No. 2) is
hereby directed to hold an election for election of a full-fledged
President of the Manipur People s Party strictly in terms of the
’
provisions as provided under the Constitution of the Manipur
People s Party and the Election Rules of the Manipur Peo
’ ple’s
Party, 1992 and amendments made thereto;
(b) The whole process of election including the Notification of the
election result should be completed within a period six months
from today;
(c) If for any reason, the Chief Electoral Officer cannot complete the
process of election of a full-fledged President of the Manipur
People s Party in terms of the direction given above, he is at
’
liberty to approach this court for seeking extension of time.
Needless to mention here that till the completion of the
election of a full-fledged President of the Manipur People s Party
’
in terms of the direction given herein above, the present interim
President shall continue.
With the aforesaid directions, the present cases are hereby
disposed of.
Interim order passed earlier stands vacated.
Registry is directed to furnish a copy of this order to the Chief
Electoral Officer, Manipur for doing the needful.
