                                         ------
For the Petitioner : Mr. Nilesh Kumar, Advocate
For the State : Mr. Fahad Allam, A.P.P.

          05/30.09.2024
                    Heard the parties.
               2. The petitioner has been made accused in connection with Bundu
P.S. Case No. 65/2024, for the offence registered under Section 18(b) of
the N.D.P.S. Act, pending in the Court of learned Judicial
               Commissioner-cum-Special Judge, N.D.P.S. Ranchi.
               3. On 26.05.2024, Bundu police apprehended this petitioner from
Tau More. On search, 3 kg and 650 grams of opium were recovered
from his possession. The quantum of seized contraband comes with the
               purview of commercial quantity.
               4. Mr. Nilesh Kumar, learned counsel appearing on behalf of the
petitioner submitted that compliance of Rule 52A of the N.D.P.S. Act
has not been done by the Investigating Officer.
               5. Considering the quantum of seized contraband, I am not inclined
to release the petitioner, on bail. Accordingly, his prayer for bail stands
               rejected.
                                                       (AmbujNath, J.)
