Heard the parties.
The petitioner has been made accused in connection with Bistupur P.S.
Case No. 55 of 2024, corresponding to G.R Case No.474 of 2024, S.T. Case
No.237 of 2024, for the offences registered under Sections 376, 323 and 504 of
the Indian Penal Code, pending in the court of Ms. Vaishaly Srivastava, learned
Additional Sessions Judge-VII, Jamshedpur.
Petitioner is said to have established consensual physical relationship with
the prosecutrix, who is a major lady, aged about 31 years.
Statement of the victim recorded during trial has been annexed with the
bail application, in which, it appears that the victim has not supported the
prosecution case and she has been declared hostile.
In view of the aforesaid fact, I am inclined to release the petitioner, on bail.
Accordingly, the petitioner, named above, is directed to be released on bail on
furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties
of the like amount each, to the satisfaction of Ms. Vaishaly Srivastava, learned
Additional Sessions Judge-VII, Jamshedpur, in connection with Bistupur P.S.
Case No. 55 of 2024, corresponding to G.R Case No.474 of 2024, S.T. Case
No.237 of 2024.
