Heard the Parties.
Learned Special P.P. has filed counter affidavit in the court
itself. Let the same be kept on the record.
Petitioner has been made an accused in connection with
Ichagarh P.S. Case No. 69/2023(S), registered under Sections 15(b)/ 25 of
the N.D.P.S. Act, pending in the Court of learned Principal District &
Sessions Judge, Seraikella.
On 03.09.2023, Ichagarh police on the basis of confidential
information intercepted a truck bearing registration no. PB-13-AR-1196
and on search, 40 kgs of poppy husk were recovered.
Learned lawyer appearing on behalf of the petitioner
submitted that the petitioner was neither arrested at the spot nor anything
was recovered from his possession.
It was further submitted that the driver of the vehicle has
talked with this petitioner due to which he has been made an accused in this
case. It was finally submitted that the driver of the vehicle has been granted
bail by this Court earlier.
Regard being had to the facts and circumstance of the case,
the petitioner named above, is directed to be released on bail on furnishing
bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the
like amount each to the satisfaction of learned Principal District & Sessions
Judge, Seraikella in connection with Ichagarh P.S. Case No. 69/2023(S).
