03/29.11.2024 Heard the Parties.
Petitioner has been made an accused in connection with
Sundarnagar P.S. Case No. 03 of 2023, registered for the offence
under Section 411, 413, 414 and 34 of the Indian Penal Code,
pending in the Court of learned S.D.J.M., Jamshedpur.
On 13.01.2023, Sundarnagar police on the basis of
confidential information raided the scrap shop of Rajendra Sonkar
and Arjun Sonkar and seized large number of vehicles and vehicle
parts from there.
It was submitted that the petitioner is neither named in
the FIR nor anything was recovered from his possession. It was
further submitted that name of the petitioner has come in the
confession of apprehended accused persons. It was finally submitted
that similarly situated co-accused has been granted anticipatory bail
by co-ordinate of this court and the case of the petitioner stands on
better footing.
Learned A.P.P. has opposed the prayer for bail and
submitted that petitioner is having one another case of similar
nature.
Regard being had to the facts and circumstance of the
case and considering the fact that apart from confession, there is no
other material against the petitioner on the record, the petitioner
named above, is directed to be released on bail on furnishing bail
bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of
the like amount each to the satisfaction of learned S.D.J.M.,
Jamshedpur in connection with Sundarnagar P.S. Case No. 03 of
2023.
