2. Petitioners are apprehending their arrest in connection with Jasidih P.S.
Case No. 115 of 2024 for the offences registered under sections 272, 273 and
278 of the Indian Penal Code and section 47(A) of Excise Act, pending in the
court of learned Additional Chief Judicial Magistrate, Deoghar.
3. On 07.04.2024 at about 7.30 p.m., Jasidih Police raided the house of
Kartik Choudhary and recovered ten liters of country made liquor and on the
confession of Kartik Choudhary, house of the petitioners was also raided and
fifteen liters of country made liquor were recovered.
4. It was submitted that the liquor was recovered from the house which is
jointly possessed by the accused persons and the quantum of seized liquor is a
very small. It was finally submitted that the petitioners have got no criminal
antecedent.
5. Considering the aforesaid facts, I am inclined to extend the privilege of
anticipatory bail to the petitioners. Accordingly, petitioners, above named, are
directed to surrender before the learned court below within two weeks from the
date of receipt of a copy of this order and the learned court below on their
surrender, shall release them on bail on furnishing bail bonds of Rs. 25,000/-
(Rupees twenty-five thousand) each, with two sureties of the like amount each,
to the satisfaction of learned Additional Chief Judicial Magistrate, Deoghar in
connection with Jasidih P.S. Case No. 115 of 2024, subject to the conditions as
laid down under section 438(2) of the Code of Criminal Procedure.
