                    Oral Order
                    05/Dated: 22.03.2024
This is an application for restoration of W.P. (C) No. 2201 of
2007 to its original file, which was dismissed for non-appearance as
learned counsel did not appear when the case was called out.
Learned counsel for the petitioner submits that he did not get
instructions as the person, who was looking after the case suffered
some bereavement in the family. He undertakes to file the necessary
documents and affidavits, once the said is restored. He begs
                    unconditional apology for this.
Learned counsel for the State also does not have any objection.
Considering the statements made in this petition as well as
submission of the counsel for the petitioner, I am inclined to allow this
petition. Accordingly, the same is allowed.
Consequently, W.P. (C) No. 2201 of 2007 is restored to its
original file subject to the condition that within four weeks, necessary
affidavits and steps should be taken by the petitioner.
After restoration, the restored Writ Petition be listed before
                    appropriate Bench as per roster.
                                                            (Ananda Sen, J.)
