For the Petitioners : Mr. Awnish Shannkar, Advocate
For the State : Mr. P. K. Chatterjee, APP
                                         -----
                        Order No.02 Date: 31.08.2024
                    1. The petitioners are apprehending their arrest in a case
registered under Sections 33(1)(C) and 63(C) of the Indian
                       Forest Act.
                    2. Learned counsel for the petitioners submits that the petitioners
have been falsely implicated in the present case and have not
committed any offence as alleged. As per the allegation, the
accused persons including the petitioners were found doing
agriculture activity inside Dandai Khurd protected forest by
removing demarcation pillar. In fact, the petitioners were not
at all involved in the alleged offence and they have been
implicated in this case merely on the basis of hearsay
statements of local people. Except the said fact, there is no
cogent material to connect the petitioners with the alleged
offence. The petitioners have no criminal antecedent with
respect to forest offence. Hence, they may be given the
                       privilege of anticipatory bail.
                    3. Learned A.P.P. opposes the petitioners
                                                     ’ prayer for anticipatory
                       bail.

                    4. Having heard learned counsel for the parties, this Court is
inclined to enlarge the petitioners, above named, on
anticipatory bail. Accordingly, the petitioners, in event of their
arrest or surrender before the court below within three weeks
from today, shall be released on bail on furnishing bail bond of
Rs.20,000/- (Rupees Twenty Thousand), each, with two
sureties of the like amount, each, to the satisfaction of learned
Chief Judicial Magistrate, Hazaribagh, in connection with G(F)
Case no.3457 of 2022, subject to the condition as laid down
                       under Section 482(2) of the B.N.S.S., 2023.
