                   learned A.P.P. appearing for the State.                          
                   2.    This appeal  is directed against the order  dated          
                   11.07.2023  passed  in Misc. Cr. Application No. 544 of          
                   2023   by  the  learned Additional  Sessions  Judge-III,         
                   Latehar, in connection with Balumath,  P.S. Case No. 69          
                   of 2022, arising out of S.T. No. 80 of 2023, whereby and         
                   whereunder  the prayer for bail of the appellant has been        
                   rejected.                                                        
                   3.    There was an  exchange of firing between the police        
                   personnel and the extremists and being outnumbered  the          
                   extremists had  fled away.  So far as  the appellant is          
                   concerned  he  seems  to have  been implicated only  on          
                   account   of allegation that  while  fleeing away   the          
                   extremists  were  calling each   other  by  name.   The          
                   appellant is in custody since 08.12.2022.                        
                   4.    Although   Mr.   Srivastava   learned  APP    has          
                   submitted  that the appellant has  got several criminal          
                   antecedents, but  regard  being had  to the  manner  of          
                   implication and the period of custody, we  while setting         
                   aside the order dated order dated 11.07.2023  passed in          
                   Misc. Cr. Application No.  544 of 2023  by  the learned          
                   Additional Sessions Judge-III, Latehar, in connection with

                   Balumath,  P.S. Case No. 69 of 2022, arising out of S.T.         
                   No. 80 of 2023, direct that the appellant be released on         
                   bail  on  furnishing  bail bond   of Rs.10,000/-   (Ten          
                   Thousand)  with two sureties of the like amount each, to         
                   the satisfaction of learned Additional Sessions Judge-III,       
                   Latehar, in connection with Balumath,  P.S. Case No. 69          
                   of 2022, arising out of S.T. No. 80 of 2023.                     
                   5.    Accordingly, this appeal is allowed.
