                                 Sanjeev Saini vs. State of H.P.                    
                                                   Cr. MP(M) No. 83 of 2024         
          29.02.2024 Present:    Mr.  N.S. Chandel, Senior Advocate with            
                                 Mr. Vinod Gupta, Advocate, for the petitioner.     
                                 Mr. Prashant Sen, Deputy Advocate General, for     
                                 the respondent-State.                              
                                 Heard.                                             
                                 Certified copy of the order dated 18.1.2023,       
                       passed by District Collector, Sirmour at Nahan in Case No.   
                       1/2019, titled State of H.P. Vs. Sanjeev Saini and others would
                       show that the question whether the bail petitioner is an     
                       agriculturist or not was decided against the petitioner by the
                       learned Collector after denying his plea that he is an       
                       agriculturist. However, the fact that his grandfather has    
                       purchased the property was not negated. It is submitted that 
                       the matter is pending adjudication before the learned        
                       Divisional Commissioner.                                     
                       2.        The FIR has been lodged on the premise that the    
                       petitioner has misrepresented his status as an agriculturist.
                       Since this question is pending adjudication before the learned
                       Divisional Commissioner as well as the fact that the case    
                       against the petitioner is based upon the documents for which 
                       the custodial interrogation is not required, the order dated 
                       8.1.2023 is made absolute.                                   
                                 The petition stands disposed of.
