This petition has been filed by the petitioner who is working as Assistant
Jail Superintendent at Sub Jail Bijapur was reflected with a penalty of demotion

by which he has been demoted to the post of Head Warden vide order dated
08.04.2019 for two years. Against which, he has preferred a departmental
appeal before the respondent No. 1 (Annexure P-1) in the year 2019. He
submits that the appeal has not been decided as yet.
2. Mr. Kale, submits that the appeal was filed in the year 2019 and all
possibility, the departmental appeal filed by the petitioner must have been
decided.
3. Be that as it may, it is expected that the respondent No. 1 shall take
decision on the appeal filed by the petitioner (Annexure P-1) within a period 45
days from the date of production of copy of this order, if it is not decided as
yet.
4. Accordingly, the petition is disposed off with aforesaid observations and
directions. All pending applications, if any, are also disposed off.
5. It is made clear that this Court has not expressed any opinion on the merits
of the case.
