This petition is filed under Section 438 of the Criminal
Procedure Code, 1973 seeking to grant anticipatory
bail to the
petitioner herein/A.1 in Crime No.235 of 2024 of Punganur Urban
police station, Chittoor District, registered for the offences punishable
under Sections 498-A, 306 and 506 Indian Penal Code.
2. Heard Mr.P.Narasimhulu, learned counsel for the petitioner
and the learned Assistant Public Prosecutor.
3. The case of the prosecution is that the petitioner/A.1 is the
husband of the deceased. On 01.05.2024, the deceased committed
suicide as the petitioner/AI and others harassed the deceased as
they were childless and sold out entire property and jewels and the
petitioner/A.1 is willing to marry another woman. The petitioner/A.1
was addicted to alcohol.. Due to unbearable harassment, the
deceased committed suicide by consuming high dose of Lorazenpam
Tablets. Hence, the crime.

4. Learned counsel for the petitioner submits that the
marriage of the petitioner/A.1 and the deceased was solemnized more
than 14 years prior to the incident. The deceased was suffering with
mental disorder, many a times she behaved differently due to
psychological disorders. He further submits that the allegations made
in the F.I.R. are false and baseless and only invented for the purpose
of impleading the petitioner in the present crime and the petitioner is
no way concerned with the present crime and prays to grant bail to
the petitioner/A. 1.

Perused the record. It reveals that the deceased died by

consuming high dose of anti depressant medicine (Lorazenpam
tablets) in the house of the petitioner/A. 1, which requires proper and
thorough investigation. Even the prosecution strongly opposed to
grant pre-arrest bail to the petitioner/A. 1 as the investigation is still
pending. This Court is of the opinion that if the petitioner is released
bail, he may tamper the evidence and this Court is not inclined to
on
grant pre-arrest bail to the petitioner/A. 1.
Accordingly, the Criminal Petition is dismissed.

As a sequel, miscellaneous applications pending, if any, in

this Criminal Petition shall stand closed.
