The Court made the following:
The present Civil Revision Petition is filed against the Order
dated 11.08.2019 in I.A.No.960 of 2019 in O.S.No.844 of 2013, on the file of
the II Additional Senior Civil Judge, Visakhapatnam, rejecting the petition
filed by the petitioners under Order 18 Rule 17 of the Civil Procedure Code
(for short the “C.P.C”), seeking to recall PWl for further cross examination.
2. It is stated by Mr S.Vijaya Kumar, learned counsel, representing
learned counsel for the petitioner, that the suit was decreed on 27.09.2023
and the matter has become infructuous. The Registry also put up a report
obtained from the e-Courts website, which shows that the suit was decreed
on 27.09.2023. In that view of the matter, the issue
raised in the present
Civil Revision Petition would not
survive.
3. Recording the submissions made by the learned counsel
for the
petitioners, the Civil Revision Petition is dismissed
as infructuous.
There shall be no order as to costs. As
sequel, all pending
a
applications shall stand closed.
