Petition under Article 226 of the Constitution of India praying that in
the circumstancesstated in the affidavit filed therewith,
the High Court may
be pleased to issue a Writ, order or direction more particularly one in the
nature of Writ of Mandamus by declaring the action of the respondents in
not refunding the EMD amount of Rs 99000/- and an amount of
Rs.40,000/- towards the balance payment entitled by the petitioner along
with interest @ 18% p.a, pursuant to the deed of contract dated 09-09-
2007 between the petitioner and the 2nd respondent entered into in
pursuance of the letter of allotment of contract dated 27/08/2007 bearing
No. P5/122(16)07-RM/K is being illegal, arbitrary, violative of Articles 14,
19 (1)g and 21 of the constitution of the India and consequently direct the
respondents to forthwith refund the money.

stated in the affidavit filed in support of the petition, the High Court may be
