Petition under Article 226 of the Constitution of India praying that in
the circumstances stated in the affidavit filed therewith, the High Court may
be pleased to issue an appropriate writ or order more particularly one in
nature of writ of MANDAMUS declaring the action of the respondents
especially respondent Nos. 4 to 7 in interfering with the affairs of Sri
Mahalakshmi Mineral Water plant situated at Chintagudiu Colony, Bantupalli
Village, Ranasthalam Mandal, Srikakulam district, which is operating by the
petitioner society, as illegal, arbitrary and against the principles of natural
justice and consequently direct the respondents not to interfer with the
affairs of Sri Mahalakshmi Mineral Water plant.

ORDER
The above writ petition is filed to declare the action
of
respondent Nos.4 to 7 in interfering with the affairs
of

Colony, Bantupalli Village, Ranasthalam Mandal, Srikakulam
District, as illegal and arbitrary.

2. Heard Sri G.Seshadri, learned counsel for the petitioner
and Smt.Hari Priya, learned counsel representing Sri G.Venkata
Reddy, learned Standing Counsel appearing for respondent
No.5.
3. Smt.Hari Priya, learned counsel- appearing for respondent
No.5, on instructions of Panchayat Secretary, Bantupalli dated
21.02.2024, would submit that the Secretary of Bantupalli is not
interfering with RO water plant. Letter dated 21.02.2024 is
placed on record.
4. In view of instructions submitted by learned Standing
Counsel, the Writ Petition is disposed of directing the
respondent authorities not to interfere with the affairs of
Sri Mahalakshmi Mineral Water Plant situated at Chintagudlu
Colony, Bantupalli Village, Ranasthalam Mandal, Srikakulam
District, without following due process of law. There shall be no
order as to costs.
As a sequel, pending miscellaneous petitions, if any, shall
stand dismissed.
