Heard Mr. M. Mahanta, learned counsel for the petitioner. Also heard Mr. M.
Sahewalla, learned counsel for the sole respondent.
Alleging wilful disobedience of the direction contained in the order dated 11-07-
Page No.# 2/2
2019, passed by this Court in W.P.(C) No. 39/2019, whereby a direction was issued to the
respondent authorities to clear the unpaid dues of all the employees/ writ petitioners in
the different writ petitions including the present petitioner, the instant writ petition has
been filed.
Mr. Mahanta submits that as per the order of this Court, a sum of Rs. 16,09,524/-
was required to be paid to the petitioner by the authorities. However, although some
amount has already been released, yet, an amount of Rs. 3,59,486/- is yet to be paid.
Therefore, there is only partial compliance of the Court’s order in this case.
Mr. Sahewalla submits that due to financial crisis faced by the corporation, the
balance amount of Rs. 3,59,486/- will be paid to the petitioner within a period of 01 year
from today.
Considering the ground stated by the learned counsel for the respondent, Mr. M.
Mahanta, learned counsel for the petitioner is agreeable to the above timeline.
If that be so, with the consent of the learned counsel for both the sides, this
contempt case stands closed by providing that within 01 year from today, the entire
balance amount of Rs. 3,59,486/- shall be paid to the petitioner.
