                         Mr Nachinolkar appearing for Respondent No.3 submits that
                    Appeal bearing No.431/2023 has been filed before the Respondent
                    No.2 against the order of which implementation is sought by the
                    Petitioner. Shri Kamat submits that he was not aware of such an appeal
                    being filed.                                                  
                    2.                                                            
                         It is submitted by Shri Kamat that the Petitioner has not been
                    made a party to the appeal. Shri Nachinolkar submits that the 
                    Respondent No.3-Appellant before the Respondent No.2 will implead
                    the Petitioner as Party Respondent and serve a notice on the Petitioner.

                    Upon impleadment of the Petitioner, the Respondent No.2 will proceed
                    to decide the appeal expeditiously in accordance with law and 
                    preferably within a period of 12 weeks from the date of impleadment of
                    the Petitioner. The application for impleadment will be made within
                    two weeks from today.                                         
                    3.                                                            
                         Nothing therefore survives in the present petition. Application is
                    disposed of. All contentions kept open. No costs.
